Terms of Service
1. Who you are contracting with
Treadline is provided by John Uschold, Vohburgerstr. 2, 80687 München, Germany. These terms govern your use of the Treadline iOS app and this website. If you do not accept them, do not use Treadline.
2. Your account
You need an account to use Treadline, created through Sign in with Apple. You are responsible for what happens under your account. Choose a username and display name that you have the right to use; we may reclaim or change a name that impersonates someone, infringes a trademark, or is abusive.
You must be at least 13 years old, or the minimum age of digital consent where you live if that is higher.
3. Treadline is not a safety device, and not medical advice
Read this one. Treadline records activity using your phone’s sensors. Distance, pace, elevation, heart rate and energy are estimates, and they can be wrong — GPS drifts, sensors fail, phones run out of battery, and a route drawn on a map is not a statement that the route is safe or passable.
- Do not rely on Treadline for navigation, for emergencies, or as a safety device.
- Treadline is a fitness-tracking product. It is not a medical device and nothing in it is medical advice, diagnosis or treatment. Talk to a doctor before starting or changing how you exercise.
- Watch where you are going. You are responsible for your own safety, for obeying traffic rules, and for deciding whether a route and conditions are safe.
4. Free and Pro
Recording activities, distance, pace, elevation gain, friends, leaderboards, this year’s routes and statistics, and heart rate and energy on every activity are free to use.
Treadline Pro is optional. It adds every year of route history, career statistics and your heatmap, heart-rate zones and effort, and side-by-side comparison with friends. Pro is sold as an auto-renewing subscription, and also as a one-time lifetime purchase.
- Payment is charged to your Apple Account when you confirm the purchase.
- A subscription renews automatically unless you cancel at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours of the end of that period.
- Manage or cancel any subscription in your Apple Account settings. We cannot cancel it for you.
- If a free trial is offered, any unused part of it is forfeited when you buy a subscription.
- Prices are shown in the App Store in your local currency and may change; a change never applies to a period already paid for.
Refunds are handled by Apple, not by us, under Apple’s own terms. Your statutory rights under EU consumer law are unaffected.
5. Your content
Your activities, routes, photos, display name and username remain yours. You grant us the limited licence needed to operate Treadline — storing your content, and showing it to the people you have chosen to share it with, such as friends, club members and leaderboards you appear on. That licence ends when you delete the content or your account, except where we must keep something to comply with the law.
6. How to behave
Do not use Treadline to:
- harass, threaten, impersonate or abuse anyone;
- upload content that is unlawful, hateful, sexual, or that you have no right to upload;
- falsify activity data to gain a leaderboard position, or record an activity in a vehicle and present it as your own effort;
- scrape, reverse engineer, disrupt or attempt to gain unauthorised access to the service;
- collect other people’s data, including their location, for any purpose of your own.
You can block and report anyone from inside the app. We review reports and may remove content, suspend an account, or terminate one for a serious or repeated breach. Where the law requires it, we will tell you why and how to object.
7. Availability
We do our best to keep Treadline working, but it is offered as-is. Features may change or be withdrawn, and the service may be interrupted for maintenance or for reasons outside our control. Keep your own copy of anything you cannot afford to lose.
8. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under the German Product Liability Act. For simple negligence, we are liable only for breach of an obligation essential to the contract (a Kardinalpflicht), and then only for foreseeable damage typical of this kind of contract. All other liability is excluded. Nothing here limits any liability that cannot be limited by law.
9. Ending it
You may stop using Treadline and delete your account at any time from inside the app. Deleting your account removes your data as described in the Privacy Policy. A lifetime purchase is tied to your Apple Account, not to a Treadline account.
10. Changes to these terms
We may update these terms. If a change materially affects you we will tell you in the app before it takes effect. Continuing to use Treadline after that means you accept the updated terms.
11. Law and disputes
German law applies, without prejudice to the mandatory consumer protections of the country you live in. We are not obliged and not willing to take part in dispute resolution before a consumer arbitration board.
12. Apple
Apple is not a party to these terms and has no obligation to provide support for Treadline. Apple is a third-party beneficiary of these terms and may enforce them against you.
